SEPARATION AGREEMENT
Prepared October 23, 2026 · Ontario, Canada
RECITALS
WHEREAS the undersigned desires to set out in writing the matters described below;
WHEREAS this document has been prepared with reference to the laws of Ontario, Canada;
NOW, THEREFORE, the following provisions shall apply:
October 23, 2026
BETWEEN:
Jordan Smith ("Party One")
AND:
Alex Lee ("Party Two")
In plain language: Jordan Smith and Alex Lee have separated and agree in writing on property, debts, the children, and support. Each party should get independent legal advice before signing — courts take that very seriously with separation agreements.
ARTICLE 1 — SEPARATION
The parties separated on 2026-08-15 and intend to live separate and apart permanently. Neither party will interfere with the other's personal life.
ARTICLE 2 — FULL FINANCIAL DISCLOSURE
Each party confirms they have made full and honest disclosure of their income, assets and debts. Each party has had the opportunity to obtain independent legal advice before signing this agreement.
ARTICLE 3 — CHILDREN
The children of the relationship are: Emma Smith, age 8; Liam Smith, age 5.
ARTICLE 4 — CUSTODY AND PARENTING
The parties will have JOINT custody of the children: they will make major decisions about health, education and welfare together. The children's primary residence and parenting schedule are set out below. Primary residence with Jordan Smith; Alex Lee has parenting time every other weekend plus Wednesday evenings.
ARTICLE 5 — CHILD SUPPORT
$650 per month starting 2026-09-01, per the Federal Child Support Guidelines. Child support will be adjusted as the Guidelines require, and both parties will exchange income information annually.
ARTICLE 6 — PROPERTY DIVISION
The family home at 123 Example Street, Vancouver is sold and net proceeds shared equally. Each party keeps their RRSP and vehicle. The joint bank account is split equally.
ARTICLE 7 — DEBTS
Joint credit-card debts shared equally.
ARTICLE 8 — SPOUSAL SUPPORT
The parties agree that NO spousal support is payable by either party, and the issue of spousal support is settled finally.
ARTICLE 9 — INDEPENDENT LEGAL ADVICE
Each party acknowledges they were advised to obtain independent legal advice, and either did so or chose not to. The parties understand this agreement affects important legal rights.
ARTICLE 10 — GENERAL
(a) This agreement is the entire agreement between the parties about these matters.
(b) It may only be changed by a written agreement signed by both parties.
(c) If any part is found unenforceable, the rest remains in effect.
(d) This agreement is governed by the laws of Ontario and the federal laws of Canada applicable there.
ONTARIO NOTE: Under Ontario's Family Law Act, married spouses equalize net family property, and both parents owe child support per the Federal Child Support Guidelines. Courts give strong weight to separation agreements, but may set aside terms on support or property where there was no full disclosure or independent legal advice, or where a term is unconscionable.

IMPORTANT: This is a template, not legal advice. Separation agreements permanently affect property, support and parenting rights. Do NOT sign without independent legal advice — ideally a different lawyer for each party — from a licensed family lawyer in Ontario. Review the agreement if circumstances change materially.
