PRENUPTIAL AGREEMENT
Prepared October 23, 2026 · Ontario, Canada
RECITALS
WHEREAS the undersigned desires to set out in writing the matters described below;
WHEREAS this document has been prepared with reference to the laws of Ontario, Canada;
NOW, THEREFORE, the following provisions shall apply:
(Marriage Contract)
October 23, 2026
BETWEEN:
Marie Tremblay ("Party One")
AND:
Jean Côté ("Party Two")
In plain language: before marrying, Marie Tremblay and Jean Côté agree in writing on what happens to their money and property if the marriage ends. Full financial disclosure and independent legal advice for each party make this agreement far more likely to hold up.
RECITALS
The parties intend to marry on 2027-06-12 in Montréal. They wish to set out their rights and obligations regarding property and support in the event of separation or divorce.
ARTICLE 1 — FULL FINANCIAL DISCLOSURE
Each party confirms they have disclosed their finances honestly and completely. Each party has had the opportunity to obtain independent legal advice before signing.
SCHEDULE A — MARIE TREMBLAY'S ASSETS AND LIABILITIES
Condo à Montréal — valeur approx. 420 000 $, hypothèque 280 000 $
REER — 65 000 $
SCHEDULE B — JEAN CÔTÉ'S ASSETS AND LIABILITIES
Compte d'épargne — 40 000 $
Voiture — valeur approx. 22 000 $
ARTICLE 2 — PROPERTY DIVISION
Each party keeps as their separate property everything they owned before the marriage and everything acquired in their own name during the marriage, except as otherwise agreed in writing. Jointly titled property is shared equally.
Neither party will claim against the other's separate property except as provided in this agreement or as required by law.
ARTICLE 3 — MATRIMONIAL HOME
The parties acknowledge that special legal protections may apply to the matrimonial/family home under their province's law, which this agreement cannot fully contract out of. They will seek legal advice about the home they occupy.
ARTICLE 4 — SPOUSAL SUPPORT
Each party waives any claim to spousal support from the other, now and in the future. The parties acknowledge they are waiving a legal right and have had the opportunity to obtain independent legal advice.
ARTICLE 5 — DEBTS
Each party is responsible for debts in their own name incurred before the marriage, and for debts they incur individually during the marriage, unless otherwise agreed in writing. Joint debts are shared equally.
ARTICLE 6 — GENERAL
(a) This agreement is the entire agreement between the parties about these matters.
(b) It may only be changed by a written agreement signed by both parties.
(c) If any part is found unenforceable, the rest remains in effect.
(d) This agreement is governed by the laws of Ontario and the federal laws of Canada applicable there.
ONTARIO PROPERTY REGIME: Under Ontario's Family Law Act, married spouses share in the growth of each other's net family property during the marriage (equalization), regardless of who holds title. The matrimonial home has special protections — it cannot be sold or mortgaged without the other spouse's consent. A prenuptial (marriage) contract can set different terms, but it cannot waive a spouse's right to possession of the matrimonial home, and courts may set aside unconscionable support waivers.

CERTIFICATES OF INDEPENDENT LEGAL ADVICE (recommended — attach)

IMPORTANT: This is a template, not legal advice. Prenuptial agreements are frequently challenged; courts look for full disclosure, independent legal advice, fairness at signing, and fairness at enforcement. Have this agreement reviewed by a licensed family lawyer in Ontario — ideally a different lawyer for each party — before signing.
