RECITALS
WHEREAS the undersigned desires to set out in writing the matters described below;
WHEREAS this document has been prepared with reference to the laws of Ontario, Canada;
NOW, THEREFORE, the following provisions shall apply:
of Jordan Miller
123 Example Street, Toronto, ON M4B 1B3
Date of birth: 1975-03-14
October 23, 2026
In plain language: this document says who gets Jordan Miller's property, who is in charge of carrying out these wishes (the executor), and who will care for any minor children. It must be signed correctly to be valid — see the execution requirements at the end.
ARTICLE 1 — REVOCATION
I revoke all wills and codicils previously made by me.
ARTICLE 2 — DECLARATION
I declare that this is my last will and testament. I am of sound mind and memory, I am acting voluntarily, and I understand the nature and effect of this document.
ARTICLE 3 — APPOINTMENT OF EXECUTOR
I appoint Alex Lee, of 456 Second Ave, Ottawa, ON K1N 5B6, as the executor of my estate, to administer my estate and carry out the terms of this will according to law. If Alex Lee is unable or unwilling to act, I appoint Taylor Brooks as alternate executor, with the same powers. My executor may be reimbursed for reasonable expenses and may claim compensation as permitted by law.
ARTICLE 4 — BENEFICIARIES AND DISTRIBUTION
Subject to the specific bequests below (if any), I give my estate to the following beneficiaries in the shares indicated:
My spouse Alex Miller — 50%
My daughter Emma Miller — 25%
My son Liam Miller — 25%
ARTICLE 5 — SPECIFIC BEQUESTS
I give the following specific gifts, which take priority over the residuary estate:
I give my watch to my brother Chris Lee.
ARTICLE 6 — GUARDIANSHIP OF MINOR CHILDREN
My minor children are: Emma Miller, age 8; Liam Miller, age 5.
If, at the time of my death, any of my children is a minor, I appoint Taylor Brooks as guardian of the person of my minor children. If Taylor Brooks is unable or unwilling to act, I appoint Robin Brooks as alternate guardian. I ask the court to respect this appointment, subject to the best interests of the children.
ARTICLE 7 — RESIDUARY CLAUSE
I give the rest and residue of my estate (everything not otherwise disposed of above), including any lapsed or void gifts, to my beneficiaries named above in the same proportions.
ARTICLE 8 — GENERAL PROVISIONS
(a) Debts, funeral and testamentary expenses and taxes shall be paid out of my estate before distribution.
(b) If a beneficiary does not survive me, their share falls into the residue unless this will says otherwise.
(c) My executor has all powers granted by law to manage, sell or distribute estate property.
EXECUTION REQUIREMENTS
Under the Succession Law Reform Act, this will must be signed by the testator in the presence of TWO (2) adult witnesses, who must be present at the same time and must also sign the will in the testator's presence.
